Prior petitioning for a greencard/LPR status by the immigrant could mean that there is an active petition pending, the petition was denied or withdrawn. This could be for a variety of reasons and does not mean that the immigrant is ineligible to adjust status. However, we do think that such cases invite added scrutiny by USCIS. If you are in this situation USAPath is not the right solution for you and we recommend that you consult with a competent attorney.

Note: if you have filed form I-485 or applied for a immigrant visa abroad you likely fall into this category.
