Prior petitioning for the same spouse typically means that that petition was denied or withdrawn by USCIS. This could be for a variety of reasons and does not mean that the immigrant is ineligible to adjust status. However, we do think that such cases invite added scrutiny by USCIS. If you are in this situation USAPath is not the right solution for you and we recommend that you consult with a competent attorney.
